1. Introduction and Acceptance

Welcome to [Al Wasit Plus – Kayan Al Mutawassit Company]. By using the application or creating an account, you fully agree to comply with these Terms & Conditions and the Privacy Policy. If you do not agree with any part of these terms, please do not use the application.

These Terms & Conditions constitute a legally binding agreement between you, whether you are a merchant or a customer, and the platform management.

2. Platform Definitions and Nature of Business

Platform: The [Al Wasit Plus – Kayan Al Mutawassit Company] application (Android and iOS) and its associated websites.

Nature of the Platform: The platform operates solely as a technology-based electronic intermediary connecting merchants (sellers) with customers (buyers). Our role is limited to providing the technical environment for displaying products and facilitating communication and transactions between the parties. Under no circumstances shall the platform be considered the direct seller, manufacturer, or guarantor of any products offered by merchants.

3. Terms Applicable to Merchants (Sellers)

Legal Responsibility for Products: The merchant shall bear full responsibility, both legally and otherwise, for the quality, safety, compliance with applicable standards, legality, and suitability for sale of all products offered through the platform.

Prohibited and Restricted Products: Merchants are strictly prohibited from listing or selling any products that violate applicable local or international laws, counterfeit goods, narcotics or controlled substances, weapons, products that may pose a risk to consumer health, or any goods that violate public morals or applicable regulations.

Platform’s Right to Remove and Take Action: The platform management reserves the right, without prior notice and at its sole discretion, to remove any product, suspend, or terminate the account of any merchant found to be in violation of these Terms & Conditions. The platform also reserves the right to take any necessary legal action and report violations to the competent authorities.

4. Terms Applicable to Customers (Buyers)

Customers are required to provide accurate, complete, and truthful information when creating an account or completing a purchase.

All financial and contractual matters relating to product warranties, exchanges, and returns shall be handled directly between the customer and the merchant responsible for the relevant product.

5. Legal Disclaimer and Limitation of Liability of the Platform, Founder, and Owner

The platform management disclaims, to the fullest extent permitted by applicable law, legal, civil, and criminal liability for the following:

Products and Content: The platform shall not be responsible for the quality, safety, or security of products displayed by merchants and does not guarantee that such products are free from defects. The platform disclaims responsibility for any physical, material, or other damages that may result from the use or consumption of products offered by merchants.

Financial Transactions and Payments: The platform does not store users’ payment card information. Payments are processed through licensed electronic payment service providers and payment gateways. Accordingly, the platform shall not be responsible, to the fullest extent permitted by applicable law, for any delay, technical error, hacking incident, or failure of financial transactions resulting from errors or technical failures attributable to payment service providers or intermediary banks.

Disputes Between Parties: Any dispute arising between a customer and a merchant concerning shipping, returns, refunds, product defects, or other matters relating to the transaction shall be considered a dispute between the independent parties involved. The platform shall not be liable for compensation or damages to either party in connection with such disputes.
